Puerto Rico

Tier II reporting is required under the federal Emergency Planning and Community Right-to-Know Act (EPCRA). Facilities that store hazardous chemicals above reporting thresholds must submit annual inventory information so emergency responders, state officials, and local authorities can prepare for incidents. Puerto Rico has a unique filing requirement: PR SERC does not accept electronic or email submissions, and reports must be submitted using physical media.

Overview

Tier II reporting is required under the federal Emergency Planning and Community Right-to-Know Act (EPCRA). Facilities that store hazardous chemicals above reporting thresholds must submit annual inventory information so emergency responders, state officials, and local authorities can prepare for incidents. Puerto Rico has a unique filing requirement: PR SERC does not accept electronic or email submissions, and reports must be submitted using physical media.

Reporting thresholds

  • 10,000 lbhazardous chemicalStored at any one time: use the maximum quantity present at any point during the reporting year, not an average.
  • 500 lbor TPQ, lowerFor an Extremely Hazardous Substance (EHS), report at this amount or its Threshold Planning Quantity, whichever is lower.
Threshold note: Puerto Rico requires physical media submission because PR SERC does not accept email submissions.

Basic filing steps

  1. 1Gather facility identification details and current hazardous chemical inventory.
  2. 2Prepare the report using EPA Tier2 Submit software.
  3. 3Export the completed file to physical media.
  4. 4Mail the physical media submission to PR SERC.
  5. 5Send printed copies to LEPC and local fire department.
  6. 6Keep proof of submission.

Common compliance risks

  • Assuming email submission is accepted.
  • Missing separate LEPC and fire department copy requirements.
  • Missing chemicals stored in separate systems, tanks, batteries, or process areas.
  • Failing to keep proof of mailing.
