Missouri: Tier II reporting fees reinstated

Missouri has reinstated Tier II reporting fees under RSMo Section 292.606, with annual fees and per-substance charges capped at $10,000 per employer.

Regulatory Radar2025 · Aug 28

Missouri has reinstated Tier II reporting fees under state statute, following a period without them. Under RSMo Section 292.606, employers required to report must submit an annual fee of $100 to the Missouri Emergency Response Commission along with their Tier II form, with an additional $20 fee for each hazardous substance or mixture reported beyond three. Petroleum retail facility owners pay a separate, lower fee capped at $50 per facility. Total fees are capped at $10,000 per year per employer, and are set to be collected for six years starting August 28, 2025.

Impact

This is a meaningful change for Missouri facilities that had not budgeted for Tier II filing fees in recent years.
